Using an Understanding of Common and Civil Law Distinctions

Using an Understanding of Common and Civil Law Distinctions

Using an Understanding of Common and Civil Law Distinctions

June 30, 2013 Posted by Scott Carlson Legal and Judicial Traditions

At New-Rule, we continuously employ our knowledge of both common and civil law systems to understand context and offer the broadest possible advice.  We believe that effective international rule of law practice requires a full understanding of the core  considerations and concepts that underlie the respective systems.  Comparative analysis can provide important tools for understanding how and why component parts of a legal system function in a particular manner.  Our team has witnessed well-intentioned efforts fail where comparative knowledge was absent.   Though transfer of legal knowledge continues to grow, we are mindful that in the dynamically evolving legal systems of the world that it is difficult to keep abreast of all changes.  For this reason, we  remained committed to sharing knowledge of comparative developments, and we welcome engagement on the same.  Armed with this knowledge, New-Rule experts will continue to be better equipped to discuss and conclude meaningful programs that show respect for differences in approach, while simultaneously seeking to promote reforms that optimize their potential for lasting sustainable impact.
