Soft International Law

Soft International Law

Soft International Law

June 30, 2013 Posted by Scott Carlson Soft International Law

After the core international human rights declarations and treaties were adopted, a series of interpretive/soft international law provisions followed, representing a series of widely held legal perspectives about the basic international human rights declarations and treaties. While these documents do not necessarily have binding effect, they do represent some of the most consensual thinking on the topics and are the beginnings of customary guidance. Donors and clients have every reason to expect full competence on these topics. New-Rule embraces this guidance as a matter of course.  Example of this type of guidance include:

  • United Nations Principles and Guidelines on Access to Legal Aid in Criminal Justice Systems
  • United Nations Basic Principles on Independence of the Judiciary
  • Basic Principles for the Treatment of Prisoners
